What Are White Collar Crimes

White collar crimes are defined as offenses that involve misrepresentation, dishonesty, and fraud that are either being investigated by law enforcement or being prosecuted as violations of state or federal law.

If the offense conduct occurs in just one state, it will be normally prosecuted by state authorities, however if the conduct occurred in multiple states or caused a large amount of financial loss (typically more than one million dollars), the case may be prosecuted by federal prosecutors from the United States Attorney’s Office or the Department of Justice. Please note that our firm does not handle civil matters such as breach of contract or consumer protection issues in which there is not active involvement by law enforcement or criminal prosecution.

Prosecutors typically view embezzlements and other crimes in which large sums of money are lost in a harsh fashion as they represent a breach of trust. Most often, the amount of the alleged loss drives not only the intensity of the prosecution, but also the potential consequences. Beyond the allegations of criminal wrongdoing themselves, white collar crimes also implicate the concealment of any proceeds of the crime through methods such as money laundering, tax evasion, or both.

While the Government has broad powers to investigate and prosecute white collar crimes, the inherent complexity of this sort of offense often creates defenses to the allegations and makes them very difficult to prove. We attack each white collar case, conducting our own parallel investigation by engaging retired federal agents and forensic auditors with expertise in white collar crimes to seek out errors in the Government’s investigation or facts and issues that law enforcement overlooked or ignored.

This, combined with Jason Lamm’s experience as a former white collar crime prosecutor in Phoenix, gives us the vision, knowledge, and insight into modern trends of white collar crime to keep us on the cutting edge so that we can represent our clients in an unparalleled fashion.
